一、道德与法律的涵义 我们通常讲的道德是指人们行为应遵循的原则和标准。
道德的定义可以概括为：道德是一定社会、一定阶级向人们提出的处理个人与个人、个人与社会之间各种关系的一种特殊的行为规范。
这一概念说明，道德是以善恶为标准，调节人们之间和个人与社会之间关系的行为规范。
道德总是扬善抑恶的。
道德一词由来已久。
早在两千多年以前，我国古代的著作中就出现了“道德”这个词语——“道”表示事物运动变化的规则：“德”表示对“道”认识之后，按照它的规则把人与人之间的关系处理得当。
从中国儒家的创始人，伟大的思想家、教育家孔子开始，千百年来。
人们就一直重视道德问题。
法律就是国家按照统治阶级的利益和意志制定或认可、并由国家强制力保证其实施的行为规范的总和。
法律属于上层建筑范畴，决定于经济基础，并为经济基础服务。
法的目的在于维护有利于统治阶级的社会关系和社会秩序，是统治阶级实现其统治的一项重要工具。
所以，法是阶级社会特有的社会现象，它随着阶级、阶级斗争的产生、发展而产生和发展，并将随着阶级、阶级斗争的消灭而自行消亡。
从侧重道德的角度，我们可以将法律定义为：在主观方面，法是国家意志和统治阶级意志的体现；在客观方面，法的内容由一定的社会物质生活条件所决定。

第一，法律与道德产生的条件与消亡各不相同。
根据马克思主义关于国家与法的学说，国家是阶级矛盾不可调和的产物。
因此，法律的产生以国家的形成为前提条件，法律是国家制定或认可的、以国家强制力为后盾的行为规范。
第二，法律与道德调整的对象与范围有所不同。
在现代国家，法律调整的对象仅限于人们的外在行为，单纯的思想或动机不是法律所调整的对象。
在古代社会曾经存在过“腹诽”、“莫须有”等以思想定罪的荒谬案件，这种情形与现代国家的法治原则是格格不入的。
而道德所调整的不仅仅是人们的外在行为，它还规范人们的心理动机。
即使在调整人们外在行为的问题上，道德所调整的范围也比法律要广泛。
第三，法律与道德的表现形式与调整机制各不相同。
许多道德规范表现为一种抽象的原则与信念，违反道德规范的后果是行为人要受到社会舆论的谴责，以及行为人自身的自责、内疚、忏悔。
而法律是以国家强制力为后盾的行为规范。
在现代国家，法律规范则必须规定明确、具体的行为模式与行为后果。
违反法律规范的后果，是由相应的国家机关追究行为人的法律责任。
第四，法律与道德的评价标准各不相同。
道德评价具有“扬善惩恶”的特点，其评价对象包括了“善行”与“恶行”，而法律评价所针对的主要是违法犯罪行为。
在通常情况下，违反法律的行为必定违反道德，而违反道德行为未必都违反法律，道德评价的标准比法律的评价标准更高。
三、运用法律传播道德 道德对社会的发展至关重要，它是考察一个社会文明程度的重要指标。
那么，如何来提高道德素质呢
我认为我们应该深刻领会法与道德的矛盾关系，采取“自相矛盾”方法，用一方制约另一方，以达到双方平衡发展的最终目的。
在尊老爱幼、恋爱关系、诚实信用、见义勇为等不适宜运用法来调整的社会关系中，我们虽然不能为这些社会关系规定具体的法律规则，但是我们可以为它们规定具体的行为后果。
譬如，规定见义勇为的行为，应当给予适当奖励，以鼓励这种行为，间接肯定该种道德现象的正确性。
就是要运用法来规定否定性法律后果，对违反道德的行为予以制裁，避免具体规定行为规范的复杂性。
对一个事物反面的否定，就是对其对立面的肯定。
否定性后果让人们知道，那些行为是非道德的，从而，深刻领会真正的道德。
并且，它也符合事物发展的全过程，即“肯定－否定－否定之否定”。
“否定之否定”往往比“肯定”更深刻。
“依法治国建设社会主义法制国家”，有利于避免对道德的侵害；有利于维持即存的社会道德观；有利于维护社会主义道德权威性；也有于法律的顺利实施，一切依法行事。

秋云，一个身残志坚的好姑娘，用自己柔弱之躯谱写了一曲助人之歌,使那些“孤帆远影”的人们重新“直挂云帆济沧海”。
徐虎，上海滩上最受欢迎的老百姓，十几年如一日上门排忧解难，把乐于助人这一中华民族流传的美德唱得绯红，表现得淋漓尽致……难怪康德老人曾说:“在这个世界上，惟有两样东西深深地震撼着我们的心灵，一是我们头上灿烂的星空，一是我们内心崇高的道德。
” 但在回答另一份调查“你如果遇到别人碰上麻烦事时会怎样对待”时，一些人却作出“悄悄走开”的选择。
的确，“悄悄走开”的选择省了一时的麻烦，毕竟“事不关己，高高挂起”，但你同时却背离了社会道德的准则。
在美丽的西子湖畔，有幸掩埋岳飞、秋瑾一代名将的地方，曾上演了一幕令人心痛的悲剧：一位小孩掉进湖中，在生与死的旋涡中挣扎，旁观者数百，却无一相救，居然有人提出“出价一百才救”的主意，孩子在人们的麻木中停止了挣扎，黑发送幼童的悲剧终于上演，可悲，可恶，可叹! 伸出你的手，足以使一个生命苏：停住你的脚，足以使一份道德重现。

谈谈社会公一说起爱护公物，也许有人会认是老生常谈，因似“爱护公物光荣坏公物可耻”、“爱护公物，人人有责”这样的口号恐怕连幼儿园小朋友也能说上几条。
但现实生活中的我们又做得怎么样呢?细心观察就会发现，校园里破坏公物的现象比比皆是:有同学为求近路而不惜践踏草坪;踢球时不小心打碎了教室的门窗;户外运动中弄坏了校园里的公共桌椅、栏杆和垃圾桶;课桌椅上经常会看见各式各样的涂鸦……你有没有想过，不论是有意还是无意，这些行为都对公物造成了损坏，也给其他同学的学习和生活带来了不必要的麻烦，还会增加学校对公物的维修费用，这可是一笔不小的开支。
每每看到这些不文明行为，你也许会皱着眉头嘟囔一句:缺德!是的，这些人所缺少的正是“公德心”，不讲社会公德，不遵规守纪。
他们从来也不曾意识到原来自己也是这些公物的“主人”，不知道公物是大家公用的物品，每一个人都有爱护公物的义务。
“人无德不立，国无德不兴”。
公民道德的好坏，体现着一个民族的精神状态，影响着一个民族事业的兴衰。
一个人的言行，往往表现出个人素质的高低，进而影响整个集体的总体素质状况。
一个公民是否爱护公共设施，从小处讲可以反映出一个人道德素质的高低，一个学校校风的好坏;从大处讲也反映了一个国家文明程度及民族素质的高低。
我国颁布的《公民道德建设实施纲要》中提出了“文明礼貌、助人为乐、爱护公物、保护环境、遵纪守法”为主要内容的社会公德。
作为中华人民共和国公民，我们都应该按这个要求规范自己的行为。
古人云:“勿以善小而不为，勿以恶小而为之。
”其实爱护公物做起来也很简单，只要拥有一颗公德之心，处处遵守学校的各项规章制度，就能保证公共设施的完好无损与正常使用。
如果你失去了今天，你不算失败，因为明天时光会再来。
如果你失去了金钱，你不算失败，因为人生的价值不在钱袋。
如果你失去了社会公德，你是彻彻底底的失败，因为你已经失去了做人的真谛。
文明礼仪涵盖了人与人、人与社会、人与自然之间的关系。
它的主要作用，既是追求个人道德的完善，又是公众利益的维护，公共秩序的体现。
说到文明礼仪，我想到了一个关于伟大的领袖列宁的故事。
有一次，列宁同志下楼，在楼梯狭窄的过道上，正碰见一个女工端着一盆水已走了一半。
那女工见是列宁，先是一惊，然后赶忙退回去给他让路。
列宁却阻止她说:“不必这样，你端着东西已走了半截，而我现在空手，请你先过去吧!”他把“请”字说得很响亮，很亲切。
然后自己紧靠着墙，让女工上楼了，他才下楼。
还有一个故事，是在澳大利亚总理霍克就任期间，有一次在一家商场内，霍克与一位老人就养老金问题发生争执。
霍克一时冲动，骂那位老人:“愚蠢的老家伙。
”老人因此把他告到法院。
霍克举行记者招待会，就自己不文明的语言，公开向这位老者道歉。
他说:“那天我非常烦恼，但这不能成为我使用那种措辞的理由。
如果我确实伤害了他的话，我愿意就此向这位先生道歉，请他宽容我的不逊。
”听了两位名人的故事，你是否为他们而感慨呢?千万不要以为文明礼仪只是伟人、名人才具备，我们将无需为自己或多或少的不文明言行而愧疚。
因为那样你就大错特错了。
我们不但要有讲文明的大人物，我们更需要一群有礼仪的民众。
个人文明礼仪是根、是本。
人要有良好的文明环境，就必须先从自身做起，从身边做起。
正像鲁迅先生说:“中国欲存争于天下，其首在立人，人立而后凡事举。
”“立人”的意思便是要完善人的思想和文明修养，首先我们要致力于读书求学，完善自身的认知水平;认知到达一定水平，就有了明辨是非的能力;分辨是非善恶、端正自身的心态，不违背自己的良知，努力使自己的一言一行都符合道德的标准，自己的修养得到完善。
这就是古人所说的:格物、致知、诚意、正心、修身。
还是那就话:“文明礼仪我先行”自身的素质提高了，我们整个校园的素质、整个城市的素质、整个中国的素质才会在真正意义上进步与提高。
