论文的主题，是一篇文章的核心和灵魂。法学毕业论文的主题，就是作者对这个法律问题研究成果的基本观点。主题应力求做到以下五点：
一要正确，符合法理和客观规律。
二要新颖，具有理论意义和实践价值，不人云亦云。
三要直白，不要隐讳。法学毕业论文的主题越直白明确越好，要让读者一看就知道，一看就懂，不能让读者云山雾罩，看后不知道说的是什么。
四是主题要贯彻始终，在文章中不能改变，应围绕中心和基本观点去写。
五是主题要简明，理论要深厚。

五、法学毕业论文格式和规范要求
(一)法学毕业论文格式
打印使用B5纸，便于存档，装订线在左面。法学毕业论文打印一般用宋体。文章题目用3号黑体，题名应简明、具体、恰当，能概括文章的特定内容，一般不超过20个字。正文内标题末不用标点符号。
一级题序及标题用“一、二、三……”序号和小3黑体。
二级题序及标题用“(一)(二)(三)……”序号和4号黑体。
三级题序及标题用“1、2、3……”序号和小4黑体。
四级题序及标题用“(1)、(2)、(3)……”序号，不用黑体。
正文用小4号宋体。这样，文章就眉清目透，井井有条。
当然，这种分题也不是绝对的，要结合实际，该怎样分，就怎样分，但要遵循分题的规则。此外，分成几级题目也是可以变通的，例如不用“1、2、3……”，改用“一是、二是、三是”或“第一，第二，第三”、“其一，其二，其三”也是可以的，但是，无论用什么，都要层次清楚。

摘要是指摘录下来的要点，主要是表述本文的主要观点，一般为100—200字。摘要的写作方法，我认为包括两部分：一是用一两句话简要概括论题的.意义，二是将法学毕业论文几部分内容表述为阐述论文观点的一段话。关键词是反映论文主题概念的词或词组，一般应选3—8个。
(二)法学毕业论文注释
现代学术视注释为学术规范与纪律的重要组成部分。在学术论著和文章中，注释不是装饰品，它具有重要意义：
一是引用他人成说，注示出处，既表示相关论说非作者独造，并对他人成果给予应有之尊重，又可为读者提供该领域的文献信息，以便利后来之研究。
二是反映了作者观点与其他学者观点的联系与区别，或者是对作者自己观点的进一步说明，因而，也是正文不可缺少的补充部分。三是大量的引文意味着作者的研究的确是在前人和他人的研究成果及所积累的资料基础上进行的，不是凭空捏造的。
注释要写得规范。最规范的，就是《法学研究》的注释方法：分为著作类、论文类、文集类、译作类、报纸类、古籍类、辞书类、港台著作、外文类等九个类别，并有注释例;非引用原文者，注释前加“参见”;引用资料非来自原始出处者，注明“转引自”;等等。详细的内容请看《法学研究》上的注释体例和文章的注释方法。
为提高刊物质量和文献信息计量、评价与研究的水平，促进学术成果在网络化、数字化条件下的交流与传播，教育部2000年1月颁发了《中国高等学校社会科学学报编排规范》(修订版)，其中注释主要用于以文章篇名、作者等及文内某一特定内容的解释和补充说明，注释序号用带圆括号的阿拉伯数字表示;参考文献置于文本，采用顺序编码制，在引文处按引用文献在论文中出现的先后顺序用阿拉伯数字连续编码，序号置于方括号内，并列举了其格式，详情请看《河北大学学报》(社科版)或其它中文社科学术期刊。
写法学毕业论文，上述两种注释方法，可选择一种使用，但不能交叉使用。
六、法学毕业论文的修改定稿、答辩
法学毕业论文初稿完成以后，应再三修改，审查是否符合要求。大到问题是否提得鲜明中肯，论点和论据有无说服力，结构层次是否严密合理，小至文字的修饰加工，有无废话，语言表述是否简洁准确，通顺流畅，符号使用是否恰当，等等。自己修改后，再交给指导教师进行修改，然后定稿。
为了使法学毕业论文能真实地反映学生的理论水平和科研能力，建立论文答辩制度是一种积极有效的措施。答辩是毕业论文的一个重要环节，是对毕业论文的全面检查。
答辩首先由学生本人简要介绍论文的写作目的和思路、主要观点，然后由答辩委员会向答辩人提问，让作者略作准备做出回答，从而进一步考查作者对所论述的问题是否有深广的知识基础，创造性的见解和充分扎实的理由。答辩提出的问题，不管作者当场是否能作出完善的回答，都是对于作者一次很好的帮助和指导。
