金银岛，双城记 读后感
教授陈瑞华的早期著作，花了一天的时间拜读完了。
书很精彩，当然，也打乱了我的计划。
有人说，从来不要把自己的生活安排的那么紧凑，因为你始终回避不了一本倾慕的好书会打乱你的生活。
陈的这本书就应该在这样的情形下闯入我的生活。
认识作者，当然作者并不认识我。
是最初在法律媒体上认识的，诸如等等报刊上得知有这么一个法学学者，其对中国现实的司法体制微词有加，尤其是我们当前的庭审制度，更是令作者感触有加。
于是，在这份愤懑或者说不甘中，作者扮演了一个公共知识分子的角色，试图以学者的力量来推动我们身边的一些个制度或者说事情的改革。
当然，这种角色，在，在法学界，也并非作者一人，象大家都熟悉的贺老师，也是属于这一类别的。
他们都怀着一种深厚的西方法治情愫，身体力行，以西方的所谓现代的法制文明理念来启蒙民智，来推进一些事情的演进，并且有些时候，还带有根本性的。
这与苏力所倡导的本土资源大概是有些不同。
以一种外界的眼光来观察我们这个社会，是他们这些知识分子的共同特征。
至今，对陈经常挂在口头上的禁止双重危险原则记忆犹新，这也是在公众场面上，其对于我国司法制度中的一些制度性缺陷的批判，诸如再审制度，实践中的司法审判出现的烙煎饼的现象的鞭挞。
之后，到了系统学习刑事诉讼法的时候，主讲人刘老师，更是对其《刑事诉讼的前沿问题》赞誉有加，以一种鼓励的语言来鼓动学生们来拜读作者的这部著作，当然，由于某种原因，我至近仍未对该著作有全面的阅读。
虽然知道现在已经有了第二版，并且，手头确实也有一本借阅来的一册。
但我想，也是以后必读书目之一。
也许是由于这时代的出现新的声音的缘故，致使其成为了一种必然。
正义不仅要实现，而且要以看得见的方式实现。
这句古老的法律谚语诠释了一种司法的性质或者说司法的理念。
也对司法的作了合理的定位，或者说找到了其应该的归宿。
司法作为一种活动，应该是过程化的活动，它诸如生产一种产品一样，我们关注的不仅仅是下了生产线的产品，而更应该关注于产品的生产程序与生产过程。
司法也具有同样的道理，它应该，甚至是必须向人们，向民众展示出具有产品性的判决书有一个合理的，令人信服的过程。
这是我读本书，对司法一个最直观的感触。
作者在书中，为我所青睐的还有另外一点，他能够从点出发，谈到面的写作路径也是为我所欣欢的。
记得曾经和一位挚友谈论法学类的著作写作方法时，我侃侃表达自己对一种写作方式的倾慕，那便是读者在读一本书时，能够感觉到有一种涓涓溪流入大海的快感。
具体来说，是以小见大的写作途径。
毫无意味，本书的写作，便具有了如此的特点，无论是作者的加入，或者是一种无谓的关心。
作者能够从审判方式的改革来窥视整个司法体制的缺憾，并且对其作出虽未来系统的，但不无深刻的剖析，应该算是本书的一个特色。
讨论的范围可以说比较广阔，有司法的性质，诸如司法的亲历性，司法的集中性，司法的被动性。
以及执行权的合理定位等等在曾经的学界里鲜为人知的理论，当然，在今天看来，也许并不具有所谓的超时空性，毕竟这些西方的东西已经为学界的人们所熟知，甚至是一个法科学生也知晓。
具体问题展示出普遍问题，正是作者独具匠心之处。
除了以上几点外，本书最显眼的地方，也在于语言的通俗性，以及案例的选择也具有相当的典型性。
如今，在法学界，以通俗性的语言来阐述精深的法学理论的这样一种文本或者说思路，已经是司空见惯了，无论老师，或者学生，都可以试验做一翻所谓的小规模的出版作业。
转借一下作者的话来说，这也许就是司法社会化所带来的法律社会化的效果之一吧。
观览本书，我们还可以发现作者所用的话语完全是西方法治式的，这或许也代表了当前人们包括我们法学学者们对我们司法体制改革的一种观察维度，即用一种所谓的现代的，先进的文明制度来改造我们这个社会，来实现除旧推新的理想。
但这种思维，自从，我读了有关法治本土资源说的作者论调以后，对此也产生了一些疑问甚至怀疑。
如何实现未来制度与我们现有社会结构的有机衔接，却是本书作者未关注的问题之一。
也许我们会出现贺老师所说的那种有具体措施导引出法治的理想效果，但这也并不能排除会出现嫁接失败的惨局，而这种双重的结局，也是每一个法学学者必须加以论证与思考的现实但却是长远的问题。
极力推崇程序正义，是作者在本书中的思想凝聚.
